Today's Poll Question: Who should regulate artificial intelligence?

The Smerconish Podcast

September 16, 2026

As AI advances at breathtaking speed, the debate over who should set the guardrails is intensifying. Michael explores the choices: federal regulation, state-by-state rules, oversight by AI companies themselves, or no regulation at all.

Hello, hello.

Michael Smerconish (0:16)

I'm feeling a little discombobulated on this Wednesday, the 16th of September. And the reason is there are so many things that I have to say and so many notes that are in front of me because yesterday's poll question and particularly today's poll question just could not be more on the news. And it's hard for me to keep up with all of the things that I'm seeing that I'm interested in reading before the start of today's radio program. Let me approach it this way.

Yesterday, yesterday I released episode one of the new YouTube show, the YouTube debate show that I'm moderating called Can We Agree? I'm thrilled with the result in terms of the number of people who watched the episode, the number of people who are watching clips of the episode like hey, the kids only want to see the clips and look, these episodes are an hour long. Some a few minutes shy, some a few minutes over, but people say they want substantive dialogue and content. I'm testing that hypothesis because yesterday I released a debate episode which features New York Democratic Congressman Tom Swasey and former Ohio State Senator Nina Turner debating whether Democratic Socialism is the future of the Democratic Party. You know the highest compliment that I can pay, the concept, the show and episode one, is that both Swasey and Turner were very pleased with the outcome, which I just think is great. They loved the experience, they feel like they expressed themselves, they said what they wanted to say, and nobody left disappointed. And yesterday in the afternoon, I did another episode. I'm not even going to tell you about it. Yeah, thank you TC, that's nice to say.

SPEAKER_4 (2:02)

I truly do.

Michael Smerconish (2:03)

TC has goose bumps.

SPEAKER_4 (2:03)

I truly do.

And I think there are six episodes completed, and I'm doing a live one tomorrow night, just on a total flyer. I just feel like there's an issue that needs to be addressed and it's moving so quickly. I'll never be able to get it taped and edited and it takes a couple of weeks. No, we're just going to do it live. We're going to do it live. So everybody who's participated has enjoyed themselves, and the people who are watching seem to really dig it. Anyway, yesterday, 30,309 votes cast. Is the Democratic Party's future democratic socialism? 71.98% said no.

Congressman Swazil will be happy to hear that result. But I went back and forth with Nina yesterday, and she loved it. I said, you did a bang up job, and everybody's enjoying it. So please, please go to YouTube. Actually, the links are embedded in my social media and in the newsletter. But watch yesterday's episode. And then today's poll question at smerconish.com asks, who should regulate artificial intelligence? Who should regulate artificial intelligence? Your choices, the federal government, the states, the AI companies themselves, or nobody?

More on that in just a moment.
