All right. Good morning, everybody. It's August 12th, 2026 We're at the Y-Refi Studios. And oh, what a day it is. We were planning on covering the Wisconsin election, some other elections this morning as the top of the show. We had Rich Barriss all lined up, and then the defense in the Tyler Robinson case dropped a response to the state's motion when it comes to probable cause, upcoming September 1st hearing.
And wow, we've got to cover it. So we've blown up in the top of the show here. We're going to cover what the defense is now stating in the Tyler Robinson case. Then we're going to have Ron Johnson talking about Fauci's text in the state of Wisconsin. We have Tom Tiffany.
So it's a great show in store for you, but we've got to start here, Blake. This is a defense response to the state's motion regarding probable cause in the preliminary hearing. It's the bind over. It's the argue for that. And we have so much to get through. And Blake, you have been reading voraciously this morning, trying to get the entire brief under your belt here. But let's just start with this clip from actually Fox News. It's an attorney on the ground that's reading it. We'll start there and get your response. Blake, on the other side, SOT 22

Attorneys representing Charlie Kirk's accused assassin filing a brief last night. They argue he should not go on trial for murder. Here's the reason.
They're arguing that much of the prosecution's case was based on hearsay testimony from Tyler Robinson's roommate. That's the case they're making.

The apparent defense strategy here isn't to prove that Tyler Robinson didn't kill Charlie Kirk, but that he didn't intend to kill anyone else and that therefore this should not be a death penalty case. Filing, Robinson's lawyers argued the state has failed to establish probable cause that the shooter knowingly created a great risk of death to another other than Charlie Kirk and himself.

What stands out, so this is, you know as well as I do, this just dropped on us a couple hours ago as people noticed that this had been filed and started to read it.
And what you look through, looking through it is it's what they don't say. So this is the defenses filing against probable cause. So remember, we had the week long preliminary hearing. All of this is just to establish probable cause. We'll have this hearing on September 1st, where the judge will hopefully finally rule, do they have all the evidence to proceed to trial? So this is a 41 page document where they're laying out their case on a whole bunch of things. And here's what is almost entirely missing from it, is any effort to contest the court charge that Tyler Robinson committed murder on September 10th of last year. There is one page, basically one page out of 41 pages, concerns that. They complain that they have testimony from Lance Twiggs, which is what's used to support Robinson's confession, his posts on Discord, and they say, this is bolstered by hearsay because Lance Twiggs didn't testify in court.
The judge already ruled on this. He said, since it's a preliminary hearing, he doesn't need to be cross-examined in person. They can do that at an actual trial. That is the only time they're addressing evidence of murder. After that, it's page after page, all on either subsidiary crimes like witness tampering, or they're just trying to throw out the death penalty because you can't get death penalty for murder unless there are aggravating factors. So in Utah, they've tried that he targeted Charlie over his political expression, and they've tried that he endangered other people at the scene, he endangered minors at the scene based on there being a big crowd, and he was firing at a long distance. That's the entirety of this briefing. So there's page after page where they're arguing, well, they literally argue at length.
