Hello, everybody. Welcome. This is the Todd Starnes Radio Show. And Happy Friday to you, America. Breaking News Friday all over the country. We've got a lot of big stories happening. And we've been following the situation coming out of Massachusetts where Lindsey Clancy, the monster mom who killed her three kids, strangled them to death, may very well get to walk out of the courtroom today. We are following the developments. Here's the very latest. And all of this is going to happen during our show today. At least that's the anticipation. So the jury came back and they are still deadlocked.
The interesting part of this now, and again, we cannot verify this information, but it's coming from reporters inside the courtroom. And we are hearing that there is one guy who is holding out. He is a dude. And he believes that Lindsay Clancy is guilty as charged. And that's the holdup here. Well, now the judge is stepping in and he has, he originally declared a mistrial that he walked that back. And he said he's going to give, that he's going to wait an hour before making the next decision. So there are a lot of moving parts here. And we'll try our very best to keep you updated on this open line Friday edition of the program. You say, what is that? In my mind, it sounded a lot better, but when you actually say it, when you vocalize it, it's a little weird. Anyway, we've got some great guests. Christy Stutzman is going to be here. And the question is, it is with a heavy heart that we report we are unable to come to a unanimous decision and will not be able to. My, well, let me ask what is the party's position in regards to that question?
**SPEAKER_5** (3:39)
Your Honor, from the Commonwealth's perspective, since the 2-way instruction has already been given and then there was like a deliberation after that, I think that it would require a mistrial at this point.
**SPEAKER_6** (3:51)
Your Honor, my understanding is that this court has the discretion to have the jury sent back for the second time. The first time that there was a report, we did not treat it as a report of deadlock. We did not instruct them under TUI. We did not give them soft TUI. We didn't give them anything. We just sent them back to deliberate. So technically, we have one report of deadlock that Your Honor gave the TUI Rodriguez charge to.
I believe under the statute as well as the case law, this court has the ability to send the jury back. The fact that that jury foreperson wrote very unusually, it is with a heavy heart that we are unable to come to a decision. Based on the earlier questions that we have, I think it would be a sound and a wise decision for this court to send it back under the law.

Well, I would find that under Massachusetts case law and statutory law, the jury did not ask to be sent back, which would be a possibility if they had requested it to be sent back to them. But under the statute and the case law, I don't feel I have any choice but to declare a mistrial.

Well, before you do, I'd like to be heard.

All right, and so that's where we're at right now, ladies and gentlemen, and it's quite a mess, and it's really quite shocking to know that there are individuals on that jury who believe this woman should be set free, a woman who killed her own children. Let me ask you this. If Lindsay Clancy had actually been a man, and we were talking about a father who killed his children, do you think the jury would have responded differently here? Because I do. I think that they would have thrown the book at that guy. I have no doubt about that. By the way, lots of copycat murders happening now where mothers are killing their children.
