SPEAKER_3 (0:13)
Thank you, Your Honor.
SPEAKER_4 (0:14)
Sir, if you please state your name, spell your first and last name for the record.
SPEAKER_5 (0:17)
Yes.
Luke Velvman (0:18)
Officer Luke Velvman, L-U-K-E-V-E-L-V-M-A-N.
SPEAKER_7 (0:24)
And where are you currently employed?
SPEAKER_8 (0:25)
Tip City Police Department, sir.
SPEAKER_4 (0:27)
In what capacity?
SPEAKER_9 (0:29)
I'm currently assigned to the Patrol.
SPEAKER_4 (0:32)
And how long have you been with Tip City Police Department?
Luke Velvman (0:34)
Altogether seven years, just a little bit over.
SPEAKER_9 (0:36)
Have you been in the Patrol a long time?
SPEAKER_8 (0:38)
No, sir.
Luke Velvman (0:39)
I was assigned to the investigation section as a general assignment detective from January, I'm sorry, from November of 2024 through January of 2026
SPEAKER_10 (0:48)
And is there a reason that you are a Patrolman now?
SPEAKER_9 (0:52)
Yes, sir.
Luke Velvman (0:53)
That was a brand new assignment that they started, I was the first person to get to do it.
SPEAKER_8 (0:57)
It was a year rotation in the detective section.
SPEAKER_4 (0:59)
So just rotation?
SPEAKER_9 (1:00)
Yep.
Luke Velvman (1:01)
As soon as you do your year, you're kind of out, the next guy goes in just to get some of those younger guys a chance to get in there, get some experience.
SPEAKER_10 (1:07)
And re-involved at all in the investigation at 932 Penningham Court?
SPEAKER_9 (1:12)
Yes, sir.
SPEAKER_10 (1:13)
And what was your involvement?
Luke Velvman (1:15)
I would say the day of the incident, I was on control and came and helped with scene security for that day. From that day forward, I was assigned to preparing search warrants, affidavits and assisting with subpoena preparation.
SPEAKER_10 (1:29)
Approximately how many search warrants and affidavits did you prepare?
Luke Velvman (1:34)
Over 30 search warrants and over, I think, I'll say eight subpoenas I assisted with.
SPEAKER_10 (1:41)
And was one of those a search warrant for a Venmo account for Alleigha Botner?
SPEAKER_9 (1:46)
Yes, sir.
SPEAKER_7 (1:48)
And did you draft that search warrant?
SPEAKER_3 (1:49)
I did.
SPEAKER_4 (1:50)
And what did you do with it after you drafted it?
SPEAKER_9 (1:52)
It was submitted through a portal to Venmo, actually PayPal, to Venmo Best Business Advertising.
SPEAKER_10 (2:00)
I'm sorry, can you repeat that?
SPEAKER_3 (2:01)
Yeah, it was submitted through a portal.
SPEAKER_9 (2:03)
It's called the Safety Hub for them specifically.
SPEAKER_3 (2:05)
So once it was signed by a judge, it was submitted to PayPal, which is who Venmo gets searched for.
SPEAKER_7 (2:12)
Okay, so PayPal and Venmo?
SPEAKER_9 (2:14)
Yeah, I guess you could say that.
SPEAKER_7 (2:17)
And once, did you submit the search for it to a judge?
Luke Velvman (2:23)
Yes.
SPEAKER_7 (2:23)
Okay, and it was approved?
Luke Velvman (2:24)
Yes, it was approved and signed, yes, sir.
SPEAKER_10 (2:26)
And then you submitted it to the hub and then you received a response from PayPal?
SPEAKER_9 (2:29)
I did.
SPEAKER_4 (2:30)
And what was that response?
Luke Velvman (2:33)
That response came through a password-secured file that came with a certified letter as well as the actual data return.
SPEAKER_7 (2:44)
And you sent a certified letter?
SPEAKER_9 (2:48)
Yes, sir.
SPEAKER_7 (2:49)
And the data, and did you review that data?
Luke Velvman (2:53)
I briefly reviewed it to make sure that it's what I asked for, but I did not analyze that data.
SPEAKER_4 (2:57)
Did you find that it was what you asked for?
SPEAKER_9 (2:58)
Yes, sir.
SPEAKER_7 (3:00)
You're on my approach.
SPEAKER_4 (3:02)
You may. This exhibit 196
SPEAKER_10 (4:04)
Well, I can tell the jury what that is.
Luke Velvman (4:06)
Yes, this is a copy, a redacted copy of a search warrant and happy data for Venmo, the account of Alleigha Botner.
SPEAKER_10 (4:14)
And is that search warrant a fairer accurate representation of the one that was approved by the judge and sent to PayPal?
SPEAKER_11 (4:19)
Yes, sir.
SPEAKER_7 (4:20)
And did you receive that data in response?
SPEAKER_3 (4:24)
Yes, certification of the case.
SPEAKER_11 (4:26)
Yes, sir.
SPEAKER_10 (5:01)
Is that the Affidavit for Business Record Certification you received along with the data from Venmo as a result of your search warrant? Yes, sir.
Luke Velvman (5:07)
That I received from PayPal.
SPEAKER_4 (5:08)
From PayPal, yes, sir.
SPEAKER_9 (5:10)
Doing business at Venmo's.
SPEAKER_10 (5:11)
Their technology.
SPEAKER_4 (5:12)
Can you please read that for the jury?
Luke Velvman (5:14)
Yes, sir. This is Affidavit for Business Record Certification. I, Rebecca Peabody, certify and declare as follows for SCM case number-GI-0112-500461-PP-SH-551357-1.
