You're listening to The Hammer and Nigel Show.
The clock is ticking. We are just about 15 minutes away from Beer Sample Friday. But first, let's see if we can help some people out. If you got a 2A question or comment for The Gun Guy, who's here, Guy Relford, we're going to try to get as many as we can here in the next 10 minutes. Fred, you're up first. Get us rocking and rolling. We got Guy Relford here.
Guy Relford (0:27)
Hi, Fred.
SPEAKER_3 (0:30)
I'm a long resident of Marion County. However, I'm a snowbird. I have a Florida driver's license. I've had a couple of gun stores tell me they cannot sell me a gun because I do not have an Indiana driver's license. However, I found a couple that said they would.
Who is right?
Guy Relford (0:46)
Well, it is a requirement of federal law that you can only sell a gun, a handgun to a resident of the same state.
Long guns, you can sell to residents of contiguous states. So the people who are saying you need an Indiana driver's license are actually correct. Now, what's interesting is there was just a district court opinion in another state, I want to say Texas, that found that restriction and that federal law to be unconstitutional. So we may see that change here at some point, Fred, but no, anytime I've ever bought a gun in a gun store, they've always wanted to see my driver's license, they're required by law to make a copy of it and keep a record, and you have to be a resident of the same state.
SPEAKER_3 (1:31)
Well, that two gun stores here in the county, Marin County, that said they would sell it to me and one did. So they said they were right, but they did a background check and all that.
Guy Relford (1:41)
Yeah, I can't speak to that, bro, but I can tell you that's been the law for a long time.
Let's go back to the phone lines and wait a minute. Is this representative Jim Lucas who's calling in?
SPEAKER_3 (1:52)
Hello, Guy. How are you?
Guy Relford (1:53)
Good, Jim. I'm surprised to hear from you, but it's nice to hear from me. How are you doing, buddy?
SPEAKER_3 (1:58)
I'm doing well, thank you.
Obviously, the tragedy out in Oregon, that's horrible. And you pray things like that never happened. But with the end result of having somebody armed on the site, stopped it and saved God knows how many lives. And we've got that going for good purpose here. And then the SBA or the NFA, I'm sorry, the victory going on there. I was just calling in to see if I could get you to help me write some good gun bills for next session to play off of that. Maybe eliminate some gun-free zones?
Guy Relford (2:35)
Yeah, well, I'll tell you what, elimination of gun-free zones is top of my list, Jim. And I'll tell you what, we just had a couple of events in the news about people being prosecuted or kids getting expelled from school for having a gun on college campuses. And you and I have worked on this before. You filed bills before. But we need campus carry desperately in this state. They've passed it in other states, including Texas.
We're a better two-way state than almost any I can think of, including Texas. We ought to have campus carry. You want to work on that. I know we got a filing deadline and Organization Day isn't even all that far away. We need campus carry and other restrictions, if not eliminations of gun free zones. I'd love to work with you on that.
SPEAKER_3 (3:21)
Let's hook up next week.
Guy Relford (3:22)
You got it, brother.
Absolutely. Let's go back to the phone lines. And Derek is called. Derek, welcome to Hammer Nigel, buddy.
SPEAKER_3 (3:29)
What do you got? Hey, how are you today?
Guy Relford (3:32)
Thanks for taking the call. Good. You doing all right?
SPEAKER_3 (3:35)
Doing wonderful. Thank you. Hey, very active in the youth 2A world, but I had a question that I couldn't answer and don't even want to think about answering. But with all the recent NFA changes, do you anticipate there ever being a loophole in the future since the ATF has given guidance that they go ahead on the 473, but if a new administration comes in, our new DOJ is in charge, our new ATF is in charge, could people find themselves in a loophole with unregistered items?
Guy Relford (4:11)
Yeah, Derek, it's really an important point. And I wrote a long social media post. I put on both my Twitter or X, just at Guy Relford, or I've also put it on my Facebook, which is also just Guy Relford. But I really, if people are interested in this issue, I really recommend that you go look me up, give me a follow or a like, whatever it is while you're on there. But yeah, and what Derek's talking about is the ATF just announced after a court decision holding parts of the National Firearms Act unconstitutional, the ATF came out and said, you know what, following that decision, which is limited to certain people in certain jurisdictions, but following that court decision, we're not going to enforce the registration requirement on suppressors and short-billed rifles and short-billed shotguns. So for instance, historically, to go buy a suppressor, and I'm a big fan of suppressors. Every time I shoot with a suppressor, I want to go buy more suppressors because you're shooting, it's so much quieter. It's not silent, but it's quieter. And you have less recoil. It's just a more pleasant experience. You're a better neighbor. Everything about it is better.
