I mean, this is, when I'm reading this story to you, there's a part of me that's like, wait a minute, is this real story that I'm reading? It's a real story. So let me give you the facts, and then we'll get into it, because there's a lot of angles this can go.
So same-sex couple sues surrogate who refused to abort their two-year-old son over a minor birth defect, okay? And this is a New York Post story. Vinnie, I'm going to come to you first on this one. So Canadian couple is suing the surrogate who carried their two-year-old, now two-year-old son after she refused their request to terminate the pregnancy over a cleft lip and possible minor heart defect. The lawsuit filed in Ontario Superior Court in May alleges the surrogate failed to keep the parents adequately informed, endangered the child, violated confidentiality, and caused emotional distress. The filing does not specify damage, but the surrogate said the couple indicated they were seeking approximately $600,000.
They didn't get the perfect child they wanted, and they threw me away, she said.
The surrogate, convinced through IVF using a donated egg and embryos created with both men's sperm, oh my goodness, their relationship deteriorated in June of 2024 After an ultrasound at 22 weeks indicated a cleft lip and possible cleft palate and minor heart defects, citing their surrogacy agreement, the couple requested an abortion. The surrogate said she would have terminated a pregnancy if the child were unlikely to survive, but would not do it for a largely cosmetic and treatable condition. The couple agreed to continue the pregnancy after Mount Sinai. Hospital doctors determined the baby was generally healthy. Tensions resurfaced when the surrogate insisted on a midwife-assisted home birth. Despite the parents' request for hospital delivery, the baby experienced breathing difficulties but recovered after receiving oxygen and was taken to a hospital by ambulance. After taking their son home, the parents ended contact with the surrogate. She sought roughly $10,000 in unpaid expenses, lost wages, transportation costs and missed pensions contributions. When she pursued the dispute in Small Claims Court, she learned the contract required arbitration and was subsequently sued for $600,000. Vinnie?

God bless her and good for her, Pat. This is exactly what happens when we start treating children like freaking property instead of people. I'm not a fan of it at all, okay? You can sign a contract with a surrogate. You can enter into legal agreements. You can negotiate responsibilities and financial obligations. But the moment that new life is created, it's no longer subject to a contract, okay? That child that you're doing this and your sperm and his sperm and a woman, that belongs to God now. And you already know where I stand, Pat. Every child is made, every one of us, every child is made the image of God. A cleft lip doesn't erase that, okay? It doesn't reduce the child's value, it doesn't justify murdering this thing because, oh, the dynamics of the kid are not the way that I want it. Since when did a birth defect become something to where you have to live or die? It starts with a cleft lip, and then, you know, next is Down syndrome, next is something, oh, his foot is different. I don't like it. They're not custom orders. This isn't freaking Amazon, this isn't Build-A-Bear, okay? They're not products that can be rejected. Pat, thank God, thank God, and I'm assuming hopefully she's a Christian, she stood up and she had the courage to stand on her convictions and say no, okay? And because of her, that little boy is alive today. And I think murder shouldn't be an option. Murder should not be an option, okay? God doesn't give any of us anything that we can't handle, okay? And there's surgeries that you can do.
I've seen multiple, multiple websites where doctors that they can fix, they can try to help that cleft lip. And that's why we have to fight. And again, going back to the Roe vs. Wade, you know, Dobbs and all that stuff, if it's not us fighting for these children, Pat, who's going to do it? They can't speak for themselves, they can't do it, we have to defend them.
