Painkiller Already, 8.20, just the boys this week. Should be a good one, Taylor.

Taylor (0:05)

This episode of PKA is brought to you by Audible, also by Lock and Load, everything over at Guerrilla Mind, really, and our merchandise. Check all of that out. But it's good to just chat with the lads.

Woody (0:16)

Yeah.

Taylor (0:17)

Just reconvene, a melding of the minds, really.

Woody (0:20)

You know, when the three of us get together, I queue well over 100

Taylor (0:26)

Sometimes, like...

Woody (0:27)

Combine.

Taylor (0:27)

I will...

Sometimes I'll have little moments of... Because you guys know how it is, where we'll finish a show, and thank God Zach keeps the list of topics, because sometimes we'll be like, what should we title it? And I'll be like, I can't remember a single thing we spoke about for four hours. And I'll go and sit and be watching something on TV, having a bowl of popcorn, and like a slumdog millionaire, something will pop up that I said two and a half hours earlier. And I'll be like out loud, be like, it wasn't that bad. Like most people might like that.

Woody (1:05)

People used to tweet me things I said during the show, and I'd be like, damn, I did say that. That's wild. I want to talk about Lindsay Clancy. People are giving this poor woman a hard time when all she did is murder children.

It seems like a miscarriage of justice.

SPEAKER_4 (1:23)

The jury's not giving her a hard time. Looks like she's got this one in the bag.

Woody (1:27)

There's one juror in particular who's holding up everything. And...

Taylor (1:31)

Which side, though?

Woody (1:33)

I don't know. That wasn't in the article I read, but the judge asked the foreman, like, hey, you guys are deadlocked. Like, is it just one person? And he's like, that one. And then the judge is like, okay, I'm going to talk to that particular juror. So he's trying to get them to not deadlock this thing.

And we'll see if the judge can influence a single juror like that.

Taylor (1:56)

I need to know what t-shirt that juror wore. Was it a guy in a Punisher logo t-shirt, or was it a woman in a pussy hat?

Woody (2:04)

Like, which one?

Taylor (2:05)

And then I can tell you which side.

SPEAKER_4 (2:07)

Well, we know which side, because the defense is like the one pushing to hurry this thing along and compel that final juror to understand what probable cause means, or not probable cause, but a reasonable doubt means.

Taylor (2:21)

Wait, but they wouldn't have access to the jury in that way at this point in the trial, correct?

SPEAKER_4 (2:28)

What I'm telling you is that the defense is the one coming forward and telling the judge, hurry this person up. We don't want to mistrial, instruct them again. It's called an Allen charge.

You can only instruct them so many times before it becomes like some sort of compelled thing where you can't force them to give a verdict. But you can be like, come on, like, here's how this works. Here's how reasonable doubt works. And you can kind of walk them through the ABCs one more time and send them back. And now that's what we're waiting on. They can't send them back.

Woody (3:03)

So if I'm interpreting what you're saying, the defense thinks perhaps 11 jurors are ready to find her free, but one is not.

SPEAKER_4 (3:11)

If not free, then one of the lesser charges.

Woody (3:14)

There's something light.

SPEAKER_4 (3:15)

There's four or five potentials. There's first degree murder, second degree murder.

Taylor (3:26)

We will be back in a minute.

From Lunatex. Which she didn't make a million dollars. I did not.

Woody (3:32)

Oh my God, that goes to her?

SPEAKER_4 (3:33)

I thought it was against her.

Zach (3:37)

I sent $3,000.

SPEAKER_6 (3:39)

Oh no.

Taylor (3:41)

You're not gonna be able to write this off.

Woody (3:43)

I thought it was for resurrecting the kids. You mean we don't get the kids' sex?

Taylor (3:50)

But there's no way for the defense to know what juror is dissenting. They're not given a tail of the tape.

No, but they're not given a tail of the tape, right? Every time the jury comes in, at the end of the day, they're like, all right, let's update the fucking box score.

Woody (4:11)

I'm kind of with Kyle on this one. So the foreman identified which juror is the holdup.

And I feel like people who've been jury watching throughout the whole trial have a vibe on what that juror might be thinking. Not for sure, right? But if they were like, Taylor said this or Woody said this, then our audience probably knows which way we're fighting for.
