OnlyFans model accepts plea in boyfriend’s fatal stabbing; Trial for Tupac’s shooting underway

Plus, the case against the man accused of planning Tupac Shakur's assassination goes to trial. But first, the trial of a Massachusetts mother accused of killing her three young children continues, as witness testimony details Lindsay Clancy's mental state before the slayings. No problem. I appreciate it. I really love discussing these cases with you because you are a working criminal defense attorney. So it kind of gives you a boots on the ground understanding of some of the issues at play here. The first one is one that I know that you've been following closely, the case of Lindsay Clancy. So let's jump in. This is out of Plymouth, Massachusetts. A mother accused of killing her three young children broke down in tears as prosecutors exhibited autopsy photos of her eight-month-old son. Lindsay Clancy doesn't deny her part in the slayings of her children, five-year-old Cora, three-year-old Dawson and infant Callan. But her defense maintains she couldn't be held criminally responsible due to the postpartum psychosis she was allegedly experiencing. Last week, friends and her former father-in-law all testified that Clancy was a loving and considerate mother, but noted that she faced behavioral struggles coinciding with the birth of each child and worsening with the arrival of her youngest. Though there were indications that Clancy was suffering, none of the witnesses realized the depths of her spiraling mental health. As the trial has now turned to the testimony of psychiatrists who treated her in the weeks and days before the killings, jurors will have to determine if Clancy's mindset ultimately lands her a life sentence in prison or an indeterminate stay in a state mental facility. The trial is ongoing and we will continue to keep you updated.
Elyse, jump right in. What do you think of the prosecution's case thus far? It looks like they're coming to a close. It seems like we're in the last few witnesses here. And in fact, by the time we release this recording, they might have already rested their case. What do you think?
Have they done it?

**Elyse Hershon** (2:51)
No way. Not in my opinion. I think they've fallen flat starting right at their opening statement, which was now a couple of weeks ago, all the way through to now. They're basically trying to paint a picture that she was either exactly. Lindsay Clancy was either exaggerating or complete or feigning, right? Making up for mental illness and that she's actually a cold calculated killer who was planning to murder her three children. And manipulated somehow the mental health system and the providers to do so. It seems so far fetched. And I don't think that they've come even close to getting there. And I think along the way, they've ruffled some feathers, certainly in the court of public opinion. And me just as an attorney watching this trial, they are in a sense weaponizing and demonizing mental illness.
And they're parading up people to say, well, she never told them that she was hearing voices, so therefore she could not have been in psychosis. It's just such an overreach. It's not factually supported medically, scientifically or anyway else. They're basically asking their witnesses to say, well, she wasn't showing signs of psychosis. She wasn't had suicidal ideations or homicidal ideations, and she was just depressed.
And using witnesses that really, it's become clear had not spent a lot of time with her. Her main psychiatrist that she met with over and over again, she had never met until she walked in to testify above Friday, so they had never met each other in person. I understand telehealth has really taken over a lot of the medical treatment and it's more efficient and there's pressure for doctors and providers to see more patients, but to never have seen somebody who was decompensating in the way that it's come out that Lindsay was just is so unacceptable. I just think that she was in the hands of either inexperienced or not qualified providers who claim to be specialists and it really came out that they weren't at all.
