This is Beyond A Reasonable Doubt with your hosts, Mark Geragos and Gary Smith.
**Lauren Conlin** (0:41)
Hello.
**Mark Geragos** (0:43)
Welcome to Reasonable Doubt and Lauren Conlin, who is very far away today, but by the time this drops, will you be 40,000 feet in the air?
**Lauren Conlin** (0:54)
I feel like no, close though, close. I'll be 40,000 feet in the air, very close to when this drops, because I will be in Los Angeles this week. So, I'm excited.
**Mark Geragos** (1:04)
What is happening in LA that will draw you here?
**Lauren Conlin** (1:08)
Oh, gosh, I wonder. The David preliminary hearings. Finally, finally, we've been talking about this for months, and they're actually beginning on Tuesday, July 21st. So I will be at the courthouse at Clara, very, very bright and early to get my seat in the courtroom.
And I'm anxious. I got to say, I'm anxious for what we're about to learn, truthfully. I am. I just, you know, I went through all of the evidence that prosecutors have made available to us through the briefing. And I have a video coming out for Los Angeles magazine detailing everything that I will follow up with an article just to remind everyone what prosecutors have. And, you know, if you're like Geragos, I'm sure you'll poke some holes as you read it. But if you're not, you'll be like, wow, that's a lot of stuff.
And I don't mean to make light of this. It's obviously nothing to make light of, but I'm nervous. That's all, Geragos. I'm just nervous.
**Mark Geragos** (2:08)
Okay. I got it. And the, do you have some video for us this week? I always like to start with a little video. What do you got for video?
**Lauren Conlin** (2:16)
Yes. Well, I would like to shift then, because the Tate brothers were subsequently arrested on Saturday, July 18th. And this is per the US Marshall Service. The warrent, the feds are not unsealing the warrent, but there are reports that this is connected to a UK extradition. And so what I would like to play for you guys is something that you were actually involved in.
**Mark Geragos** (2:44)
I was going to say, in full disclosure, we represented, the firm represented the Tate brothers several years ago. Tina Glandian, in fact, there's Tina right there, flew to Romania to help extricate them from, and get them released from custody. But you might as well play it.
**Lauren Conlin** (3:02)
Yeah, let's play it. And again, this was three years ago. So just keep that in mind.
**Tina Glandian** (3:12)
And they asked the court for their freedom based on the lack of evidence against them and the lack of any criminal history that neither of them has. There were also additional factors mentioned, one of which is the fact that Tristan has a new three-week-old baby who he has never met because I was going to say he's been in custody, brothers have been in custody longer than his baby has even been alive. We are now awaiting a decision by the court and we are hopeful that they will do the right thing and let the Tate brothers out of custody.
It's no secret that the Tate brothers are controversial public personas. But this is not about their public persona and whether you agree with their viewpoints or not. This is about the violation of international human rights and due process of law.
So far the system has failed. The Tate brothers, who are both US citizens, have been in jail for over 30 days now without bail and without any charges being filed against them. And again, Tina, can you repeat the last part? Without bail and without any charges being filed against them. This investigation started in April of last year and the fact that today is February 1st and no charges have been filed in the 10-month period should speak volumes as to the state of the evidence. The continued detention of the Tate brothers under these circumstances is a violation of international human rights law and of the EU guidelines and Romania obviously is a member of the EU. So despite what anyone's viewpoint might be as to the Tate brothers and if they agree or don't agree, everybody should be concerned about this global issue. My firm has joined the Romanian legal team because we want to ensure that our citizens are protected when they're abroad. And we will continue to fight to get the Tate brothers out of custody and home where they belong.
