What strategy will the Defense use to prove Clancy was in a state of postpartum psychosis?
I'm Lynden Blake and you're listening to That's So Criminal.
There is this big debate over Lindsay Clancy and whether she should be locked up for the murder of her three children. She strangled the young kids ages five, three and eight months with exercise bands by applying extreme pressure around their necks. Then she tried to take her own life by jumping out of a window, leaving her paralyzed from the waist down. Most people agree this woman is insane. A sane person would never kill their children. But in the court of law, there's a difference between being insane and being legally insane. Let's revisit this case. Andrea Yates, back in 2001, killed her five children. She drowned them in a bathtub. She got off on not guilty by reason of insanity. And she is still locked up in a high security mental hospital to this day, because her defense was able to prove that during that time, when she was drowning her children, she was having this psychosis episode. I spoke with Dr. Sonny Slaughter. She's an expert witness in high profile cases, a jury consultant and a legal analyst, who explains how the defense tries to make their case for a psychosis diagnosis for Lindsay Clancy. Can you explain how in this case, the insanity defense is treated in Massachusetts that may be different in other states?

It's just really about language. And you know, we call it insanity. In most cases, this is an insanity defense. And a lot of times people don't understand what that language looks like. They think it looks like, oh, well, you can just tell whether somebody is insane or not insane. But really, there is a high bar of scoring and metrics at the courts and the process that they go through. That's not a lot of times we say, oh, that person was crazy or they got a mental health issue.
But we don't actually know about their diagnosis. So in court cases and in criminal cases, going through court systems, there has to be a measure, not of you just thinking somebody is crazy just because they did something that doesn't make sense. But it is lining up the medical metrics, medication, just what Lindsay's attorney is doing right now. And coming up with a clinical diagnosis that then meets the measure of the courts. And this has to be decided by the judge.
Is this person what I have then presented? Is it sound reasonable? Does it meet the measure of the law? And that is clinical diagnosis, and behavior, and the law, for me to say that this person was legally insane. Notice, legally insane, not just the words that we use all the time. We say, oh, that person is crazy.

What strategies do you think Reddington is going to use to try to prove to the jury, beyond a reasonable doubt, that Lindsay Clancy did commit the act, but she's not criminally responsible? Because we know this is interesting because she admitted to killing her children.
